“Service(s)”

means collectively any online facilities, tools, services, products, widgets, API or information that OneDome Ltd makes available through the Site either now or in the future;

“UK and EU Cookie Law”

means the relevant parts of the Privacy and Electronic Communications (EC Directive) Regulations 2003 as amended in 2004, 2011 and 2015; and

“We/Us/Our”

“You/Your”

means, subject to the Terms and Conditions, any User (including Commercial Users) of Our Site and of our content and Services.

This Privacy Policy applies only to Your use of Our Site or Our Services. It does not extend to any websites that are linked to from Our Site. We have no control over how Your data is collected, stored or used by other websites and We advise You to check the privacy provisions of any such websites before providing any data to them.

OneDome handles Personal Data both as a Controller – such as in respect of your OneDome account and as a Processor on behalf of third parties – such as estate agents who use our Services. This Policy applies to Our use of all data collected directly by us as a data Controller or processed by us on behalf of third parties, as data Processor, in relation to Your use of Our Site or Our Services via Your usage of technology such as, but not limited to, HTML widgets hosted on third-party platforms.

We may collect and process the following information:

4.1 Information that You provide to Us, via Your use of Our Site or Our Services, where You voluntarily consent to submit it, for example, when:

  • registering for an Account
  • filling in forms or fields on Our Site
  • accessing and interacting with Services provided by Us
  • corresponding with us in any way

The information that You provide to us may necessarily include Personal Data including Your name, address, correspondence details, financial details, property valuations or other such data, pertaining to You, Your home or in relation to Services that You procure from us.

4.2.2 Information pertaining to Your use of our site, including full URL data, use or view of products and services and site performance and usage data pertaining to Your visit.

4.3 Information that we process on behalf of third parties whom You interact with whilst using Our Site or who employ Our Services to facilitate their interaction with You and whom we partner with, including, providers of valuation, anti-money laundering, due diligence, search, analytics, financial services, professional and other services.

5.2 We use data, including Personal Data, collected from You, to facilitate Your use of Our Site, Our Services and those of third parties with whom You wish to interact. This includes:

  • supplying Our products and Services as well as those of permitted third parties to You or providing You with information about same;

With Your affirmative consent (which You may revoke at any time by clicking a link to unsubscribe, by changing Your preferences from within Your account management page or by contacting us at [email protected]) and/or where permitted by law, We may also allow permitted third parties to contact You in respect of their good and services, strictly as they relate to Your use of Our Site or Our Services. We will not, however, send You any unsolicited marketing or spam and will take all reasonable steps to ensure that We fully protect Your rights and comply with Our obligations under Data Protection Legislation including the Privacy and Electronic Communications (EC Directive) Regulations 2003, as amended in 2004, 2011 and 2015.

6.1 We only keep Your data for as long as We need to in order to use it as described above in section 5, and/or for as long as We have Your permission to keep it and/or as required under Data Protection Legislation.

6.2 Your data will only be stored within the European Economic Area (“the EEA”) (The EEA consists of all EU member states, plus Norway, Iceland and Liechtenstein).

6.3 Data security is of great importance to Us, and to protect Your data We have put in place suitable physical, electronic and managerial procedures to safeguard and secure data collected through Our Site.6.4 Steps We take to secure and protect Your data include:

7.1 We may share Your data with other companies in Our group where we have a legitimate interest to do so. This includes Our subsidiaries and/or Our holding company and its subsidiaries.

7.2 We contract with third parties to provide them with Services to help facilitate Your engagement with their products and services and also to supply products and services to You on Our behalf. These may include, but are not limited to, payment processing, delivery of goods and services, property valuation services, other property related searches, conveyancing, mortgage lending, anti-money laundering searches, due diligence searches, search engine facilities, advertising and marketing. In some cases, the third parties may require access to Your Personal Data. Where any of Your Personal Data is required for such a purpose, We will ensure that Your data is processed securely, and in accordance with Data Protection Legislation.

7.2 We will only share Personal Data where We have a lawful basis for doing so. typically, although not exclusively, this will be because:

7.3.1 You have given us clear, unambiguous affirmative consent to do so; or

7.3.2 the processing is necessary to fulfil a contract that You have entered into or as a preliminary to You entering into a contract; or

7.3.3 there is a legitimate interest in providing your Personal Data to a specific third party, for example, where You have requested a specific service from them or via their website and Your personal data is required to maximise the delivery of that service to You.

7.4 We may compile statistics about the use of Our Site including data on traffic, usage patterns, user numbers, sales and other information. All such data will be anonymised and will not include any Personal Data. We may from time to time share such anonymised data with third parties such as prospective investors, affiliates, partners and advertisers. Data will only be shared and used in compliance with Data Protection Legislation.

7.5 In certain circumstances We may be legally required to share certain data held by Us, which may include Your Personal Data, for example, where We are involved in legal proceedings, where We are complying with the requirements of legislation, a court order, or a governmental authority. We do not require any further consent from You in order to share Your Personal Data in such circumstances and will comply as required with any legally binding request that is made of Us.

9.1 When You submit Personal Data, to Us You will be given options to restrict Our use of Your data. In particular, We aim to give You strong controls on Our use of Your data for direct marketing purposes (including the ability to opt-out of receiving communications from Us or select third parties, which You may do by declining the option to receive such communications at the point of accessing the Services or by unsubscribing using the links provided in Our emails, by managing Your Account or through making a request under section 11 – below.

10.1 You may access certain areas of Our Site without providing any data beyond that required for the function that You wish to use, to operate. However, to use all features and functions available on Our Site or within Our Services and specifically where Your Personal Data is a prerequisite for the operation of that Service You may be required to submit or allow for the collection and processing of certain data. Where that is the case, We will advise You at the point that You seek access to such Services. Where, in such circumstances, you chose to withhold any Personal Data requested by us, it may not be possible to access parts of Our Site or to use the Services that you are requesting access to.

11.1 Subject to the provision of this Clause 11, You have the legal right to:

11.1.1 ask for a copy of any of Your Personal Data controlled by Us.

11.1.2 correct any information that is controlled by Us.

11.1.3 delete information controlled by Us

11.2 Where We process Your data on behalf of a third party (who is the data Controller) you should make requests in the first instance to them.

11.3 We will not charge a fee for complying with such requests unless the request is manifestly unfounded or excessive or unless repeated requests are made for the same data. Such fee shall not exceed £10 per instance.

11.5 Where We are the Controller of the Personal Data that You have requested, We will respond to the request within 1 month, unless the request is particularly complex.

11.6 As data Controller We may exercise the right to withhold details of Personal Data requested by You where disclosure would adversely affect the rights and freedoms of others.

12.1 Our Site may place and access certain first party Cookies on Your computer or device. First party Cookies are those placed directly by Us and are used only by Us. We use Cookies to facilitate and improve Your experience of Our Site and to provide and improve Our products and Services.
