Right of Way Through Graveyard Please Note: Leading away from the rear corner of the footpath / Sunday School to a point in the corner will be a pedestrian footpath for use by the purchaser at all times and for all purposes linking to the area of adjoining field which has been acquired for amenity ground.
Outside The property is surrounded by a graveyard. There is only very limited areas of land on each side of the property which are included in the Title. The two principal pedestrian accesses into the graveyard will be part of the title, but both of these will be subject to rights of way at all times and for all purposes for those visiting the graveyard.
In the adjoining field a sizeable area of level ground has been acquired to provide amenity space and accommodate a private disposal system with soakaway to serve the proposed development.
Services The property has the right to construct a septic tank within the adjoining land which is incorporated in the sale. From this septic tank a soakaway drainage field can be taken out into the neighbouring farmers field. In constructing the drainage field the purchaser will be required to ensure topsoil removed from the overflow drainage pipe runs should be set aside for putting back over the trench lines once the soakaway drains have been constructed. Buyers Auction Administration Fee All successful buyers should note that on exchange of contracts a Buyer's Administration Fee of £2,000 plus VAT (total £2,400 inc VAT) is payable to Kivells. Please note if the lot is sold prior to auction, these fees remain payable. There are no discounts for multiple lots purchased and you must consider this when bidding/offering prior.

Deposit A 10% deposit will be required to be paid by the successful bidder upon the fall of the hammer and the contract at this point is legally binding. The deposit is to be paid to Kivells as auctioneers and can only be paid by UK bank cheque or bank transfer. All bidders must only bid if they can make this payment. A separate payment will be taken for the auctioneers administration fee.
Completion Will take place at 28 days from the auction, or earlier by agreement between the parties.
Conditions of Sale These will not be read out in detail at the auction but will be available for inspection from the seller's solicitors and in the auction room prior to the sale. All interested buyers will be assumed to have acquainted themselves with the conditions of sale.
Boundaries Any purchaser shall be deemed to have full knowledge of all boundaries and neither vendor nor the vendor's agents will be responsible for defining the boundaries or the ownership thereof. Should any dispute arise as the boundaries or any points on the particulars or plans or the interpretation of them, the question shall be referred to the vendors agent whose decision acting as experts shall be final.
