GENERAL REMARKS & STIPULATIONS    McCartneys have been favoured with the instructions to offer by Public Auction these attractive enclosures of land.

SITUATION    The land is located close to the hamlet of Twitchen, 5 miles west of Craven Arms and 8 miles east of Knighton. All lots have convenient roadside access.

POSSESSION    Full vacant possession will be given upon completion.

INGOING    The property is sold free of any ingoing. No claim for dilapidations and deterioration (iif any) or other offset will be allowed.

SERVICES    All of the land is served by a mains water supply for the watering of livestock at the present time. Should the lots be purchased by different buyers it may be necessary for the purchaser(s) to make new arrangements in relation to the connection into the mains supply and the provision of meter(s) etc. Such costs will be borne by the purchaser(s) of each lot.

GROWING TIMBER    All timber is included in the sale.

PLANNING UPLIFT    An Uplift Clause will be placed on all of the land. This will state that should planning consent be granted on any parcel (or part of any parcel) for development and if such planning consent leads to an increase in value then the vendors wil be entitled to 50% of such increase in value. This Uplift Clause would be operative for a period of 255 years fron the Completion Date.

(b)    The purchaser shall be deemed to acknowledge that he has not entered into this contract in reliance on any of the said statements, that he has satisfied himself as to the contents of each of the said statements by inspection or otherwise, and that no warranty or representation has been made by the vendors, or the said agents in relation to, or in connecting with the property.

(c)    Any error, omission or mis-statement in any of the said statements shall not entitle the purchaser to rescind or to be discharged from this contract, nor give either party any cause for action.

CONDITIONS OF SALE    The property will be sold subject to the special conditions of sale incorporated in the Contract which has been prepared by the vendor's solicitors. The Contract and Special Conditions of Sale will be available for inspection at the offices of the agents and the vendor's solicitors for seven days prior to the date of the auction. The purchaser will be deemed to have notice of such conditions and all the terms thereof and will be deemed to bid on these terms whether or not the purchaser has inspected them. The Special Conditions of Sale having been available to the purchaser, will not be read out at the auction.

METHOD OF SALE    The land will be offered for sale by public auction (subject to prior sale) on Thursday 17th May 2012 at 3 pm. PARTICULARS OF LAND AT HOPE FARM, TWITCHEN.

GENERAL    In a part of the county of Shropshire where there is not a ready supply of land coming onto the market a prime opportunity to acquire sound pasture and amenity land presents itself with this disposal. All of the land is of a very gently slope and southerly aspect.

LOT 1    A single grassland enclosure of 0.63 acres (or thereabouts) which has roadside access and mains water currently serves a water tank adjacent to the western boundary. It will be necessary for the purchaser at his own expense to provide a new meter.

LOT 2    A single enclosure of pasture land and comprising some 0.86 acres (or thereabouts). Adjacent to the south-eastern boundary is a Stables and General Storage Building constructed of brick, stone, timber and slate and measuring 42'6" x 11'4". Within this building is a mains water supply. The successful purchaser will need to install a new meter.

LOT 3    A single grassland field covering 1.58 acres. Mains water is provided to a tank on the south western boundary. The successful purchaser will need to install a new meter.
